Article 1065 of the Civil Code stipulates that both parties may agree that property acquired during marriage and premarital property belong to each party separately, jointly, or partially separately and partially jointly. The agreement shall be in writing. The agreement of the spouses on property acquired during marriage and premarital property is legally binding on both parties. Upon divorce, if there is an agreement, it shall be handled accordingly; if there is no agreement, it shall be handled according to the statutory property system.
