Article 1079 of the Civil Code stipulates several situations where divorce shall be granted if mediation fails, including bigamy or cohabitation with another person; domestic violence or maltreatment or abandonment of family members; gambling or drug addiction with repeated education; and separation for two years due to incompatibility. It also adds that if after a court judgment not granting divorce, the parties have separated for another year and one party files for divorce again, the divorce shall be granted.
