Priority Factors for Determining Custody of Minor Children

Article 14 of the Interpretation (II) stipulates that in divorce proceedings, if both parents request direct custody of a minor child over the age of two, and one party has forcibly taken and concealed the child, the court shall, in accordance with the principle of the best interests of the minor child, give priority to the other party for direct custody. This reflects a negative evaluation of snatching and concealment, and treats it as a factor unfavorable for obtaining custody.
